Please read carefully our Terms & Conditions mentioned below before using our portal services / information or any part of this portal.
The Terms & Condition herein are termed as an “Agreement” between TCPL and the user / visitor / member / subscriber. The major purpose and objective of Converthink is to serve as a preliminary medium of contact for exchange of information for its users / members / visitors who have a bonafide intention to contact and/or be contacted for the purposes related to genuine matrimony matches and for other matrimony related services / information.
This website www.converthink.com , including any sub-domains, and any other websites through which its services are made available like our mobile, tablet and other smart device applications, and application program interfaces etc, (hereinafter collectively referred to as "converthink or converthink") is owned, hosted, operated and managed by Triptales Commercials Pvt. Ltd. (hereinafter referred to as TCPL), a company incorporated in India under the Companies Act, 1956 and having its registered office at Bhubaneswar, Odisha. These terms and conditions, privacy policy and guidelines regulating the use of these Services constitute a legally binding agreement between converthink and the User (the “Agreement”).
converthink and/or any other website(s) linked to this website is an online information and communications service platform provided to you, subject to your compliance with the terms and conditions set forth below.
By accessing or using “converthink”, you agree to be bound by the Privacy Policy and Terms & Conditions set forth in the website. By using this platform you indicate your understanding and acceptance of these terms.
If you do not agree with any of these terms and conditions, you should not access or use ‘converthink”. In the event of non-compliance with this terms & condition, converthink has the right to limit or terminate your access or usage rights to the platform immediately or remove non-compliant information or both as the case may be , in accordance with the information technology (intermediary guidelines and digital media ethics code) rules, 2021. TCPL may amend/modify any of these points in the privacy policy and terms & conditions at any time, and such modifications shall be effective immediately upon posting of the modified privacy policy and terms & conditions on converthink. You should review the amendments related to privacy policy and terms & conditions periodically to be aware of such modifications and your continued access or use of converthink, shall be deemed as a conclusive proof of your acceptance of these modified privacy policy and terms & conditions, as amended / modified from time to time. TCPL shall suspend the operation of converthink for support or technical up gradation, maintenance work, in order to update the content or for any other reason. If you use converthink in a manner inconsistent with these privacy policy and terms & conditions, then TCPL may terminate your access, block your future access.

 
  1. Terms of Reference:
  1. Please read the following terms and conditions very carefully before using the website. Accessing, browsing or otherwise using the website implies your agreement to be bound by all these terms and conditions ("Agreement").
  2. The online platform for all these services / information in www.converthink.com refers to (the "Website" or “converthink” or “converthink”).
  3. If you do not want to be bound by the Terms and Conditions, you must not use the Website or the converthink Services. The Terms and Conditions also include the applicable policies which are incorporated herein by way of reference and as amended from time to time (the "Terms and conditions").
  4. In these Terms, (“Users” or “You”) refer to members who are accessing the Website, its contents or using the converthink offered Services.
  5. “Registrant” refers to users which also include persons such as father, mother, brother, sister, relative or a friend of the prospective bride / bridegroom.
  6.  "converthink Services" means a collective reference to the converthink service provided by our matrimony services under converthink website and TCPL (the “Company”).
  7. “TCPL” or “Company” refers to as TCPL, a registered company under Compnay Act 1956, with its registered office at Bhubaneswar , Odisha
  8. Terms (“Member or Customer”) refers to any individual who has registered in converthink website to avail the matrimony services.
 
  1. Scope of this document:
  1. You understand and acknowledge that converthink acts as an "Intermediary" as defined under clause (1) sub-clause (w) of Section 2 of the Information Technology Act, 2000. converthink is a brand owned by TCPL, which owns, retains and has complete rights in converthink and the www.converthink.com Website / App / converthink Service.
  2. converthink acts as a platform to enable any user to register themselves on it (by filling the mandatory fields and optional fields, if any in the registration form) to voluntarily search for profile(s) from the database of converthink’s already registered users, for seeking prospective lawful matrimonial alliances for them.
  3. converthink retail store or office may also be able to assist you to create your profile; however, you must have a valid/operational mobile phone number and an email id. The profiles in the database of converthink are classified broadly on the basis of language, region, caste for the ease and convenience of its members / customers. converthink Members are provided with free/paid access for searching profiles from the database of converthink, as per the partner preference set by you on the Website/Applications (App) and you can shortlist the profiles of your interest
 
  1. Eligibility for Membership / User:
  1. converthink Membership and rights of admission is reserved solely for:
  1. Indian Nationals
  2. Persons of Indian Origin (PIO).
  3. Non Resident Indians (NRI).
  4. Persons of Indian Descent or Indian Heritage
  5. Persons who intend to marry persons of Indian Origin.
 
  1. As an Users you confirm that you are :
  1. 18 years or above (if you are a woman) or 21 years or above (if you are a man)
  2. If you have applied for Divorce, you may register on our website/App by stating "Awaiting Divorce".
  3. If you are a resident of any other Country, you are legally competent to marry as per the local rules applicable to your country and you shall comply with the Indian laws for marrying a person of Indian Origin
  1. In case you are a Registrant of the prospective bride / bridegroom and has created profile in converthink Website/App on behalf of them or is accessing the converthink Website/App on behalf of them implies that you have taken their consent for their profile creation in converthink and for accessing the converthink Website/App.
 
  1. Profile Registration:
  1. We expect that you would complete the online registration process with fairness and honesty in furnishing true, accurate, current, complete information and with providing recent photos of you which will help you to meet your parameters. We expect you to read the relevant column before finalising the details or selecting the option available or uploading the photo. You are requested not to key in details of the profile in field other than the applicable field (including mentioning id's of other platforms/websites/App or repeating your details in another fields, after filling them once in the relevant fields or others photographs. In order to serve you better if converthink requires additional details you agree to provide it. You may also give a missed call to any of our retail outlets/office phone number for us to call you back and assist you in getting your profile registered on our website/App. Further you may fill in your email id and phone number in any of our registration campaigns appearing in various websites as part of our advertisements, based on which you may receive call from our Customer Support and assist you in getting your profile registered on our website/App. converthink may also reproduce your profile information in other websites owned by TCPL, including community based websites to provide better matching Profiles to you.
  2. Providing False information -- If at any point of time converthink comes to know or is so informed by third party or has reasons to believe that any information provided by you for registration (including photos) or otherwise is found to be untrue, inaccurate, or incomplete, converthink shall have full right to suspend or terminate your converthink membership without any notice and forfeit any amount paid by you towards converthink membership fee and refuse to provide converthink service to you thereafter.
  3. Blocking of Registration -- converthink also reserves the right to block the registration of your profile on Website/App, if any, in the case of your contact details/links being entered in irrelevant fields or if there are errors in any data entered by the converthink members in their profile.
  4. Duplicate Registration -- Registration of duplicate profiles of the same person is not allowed in converthink Website/App. converthink shall have full right to suspend or terminate such duplicate profile (without any notice).
  5. You acknowledge and confirm that your registration with converthink and the usage of converthink services is with the bonafide intention of marriage and not otherwise. converthink Membership is restricted strictly to the registered converthink individual member only.
  6. Organizations, companies, businesses and/or individuals carrying on similar or competitive business cannot become Members of converthink and nor use the converthink Service or converthink members data for any commercial purpose, and converthink reserves its right to initiate appropriate legal action for breach of these obligation.
 
  1. Assisted Service Guarantee is applicable only for the users:
  1. Who have availed the Assisted Service for the first time.
  2. Who have more than 50 matching profiles based on the partner preference set by them at the time of the Assisted Welcome Call.
  3. Who has not narrowed down the partner preference, once the Assisted service starts.
 
  1. Membership Packages:
  1. We have various premium membership packages called Gold, Diamond, Platinum, Till You Marry, Assisted Services and Royal Matching.
  2. You shall opt for any of our premium membership packages varying between three months and above with different price to access various premium features.
  3. The Fair Usage Policy (FUP) limit on Phone view count and Count on Personal message for all the premium membership packages and its benefits, please visit 'Payment Options' page.
7. No ‘Add to Cart’ Option:

Unlike product base company, we don’t have any option to ‘Add to Cart’, as we are a service provider through online mode. In our case the customer just need to click on ‘Pay Now’ below the package which he/she need to purchase. Those companies which have product related business have ‘Add to Cart’.
 
8. Mode of Payment:
  1. Payment made by cash / cheque / Net Banking / Debit / Credit Card/ Paypal/ UPI/ RTGS/ NEFT/ would be in accordance with the prevailing RBI guidelines. Activation of paid converthink service shall be subject to realization of the said payment. In case of dishonour of Cheque/demand draft; you shall be liable to pay applicable bank’s cheque/DD bouncing charges. Further converthink service to your account will be deactivated / suspended until you settle the value of the payment and applicable bank charges.
  2. If in case you choose any paid package from converthink / TCPL with a value of Rs.2,00,000/- (Rupees Two Lakh Only) or more, using any payment gateways for collection of payment through credit/debit card or other payment instruments; then, you agree to provide us with your Permanent Account Number (PAN) / Form 60/61 of the Income Tax Act, 1961.

9. Refund and Assignment
  1. The payments made by any Users to converthink / TCPL by way of membership / renewal fee / auto renewals are treated as non-refundable.
  2. Users shall not assign or transfer your converthink membership to any other person or entity, and such an act shall be treated as violation of terms and conditions. Payment once made for converthink services cannot be assigned to any person/party or adjusted towards any other product or packages provided by the Company.

10. Renewal
  1. We automatically renew all paid Memberships before the expiry of the term of the paid Membership. You agree that your account will be subject to this automatic renewal feature equal to last duration and last paid price.
  2. Every converthink packages post validity period (varies from package to package), shall be renewed.
  3. If you do not want your paid membership to automatically renew, you must cancel your paid membership. In case of cancellation you have to mail to info@converthink.com

11. Account & Data Security
You are solely responsible for safeguarding the confidentiality of your converthink login credentials such as your User ID, password, OTP, etc., and for restricting access to your computer/mobile to prevent unauthorized access to your account. We, as a Company do not ask for Password and you are cautioned not to share your password to anyone. You agree to accept responsibility for all activities that occur under your account.

12. Role and Responsibility of converthink
    1. converthink reproduces your details once you register on our website /App on "as is as available" basis and also share your profile with other registered converthink members within website(s) of TCPL
    2. converthink's obligation is only to provide an interface to its registered members to search their prospect themselves without any assistance or obligation
    3. The profile search conducted by any User and the matches shown thereof are automatically generated by converthink, and based on the partner preference set by you. In case of Users changing their partner preference on the Website/App, then the automated system generated prospect results of the Website/App may also undergo corresponding changes.
    4. converthink does not prohibit any Users from sending interest to your profile or communicating to you based on their partner preference. But you are at the liberty to deny their interest or proceed further if you are interested.
    5. converthink cannot guarantee or assume responsibility for any specific results from the use of the data available from the converthink service or from other matrimonial websites owned by TCPL including community based websites.
    6. converthink shall safeguard sensitive user information using security standards, authentication mechanisms, access controls and encryption techniques.
    7. converthink cannot guarantee the complete protection of user data while it is in transit, or prevent any tampering of the data by a third party with malicious intent before the data reaches the converthink servers.
    8. converthink does not authenticate/endorse any information of any profile and hence you as a user need to verify the credentials and information provided by other users.

13. Responsibility of converthink Members & Guidelines:
    1. You shall safeguard your profile information by creating a strong password during profile creation with combination of alphabets, both upper and lower case and numbers.
    2. Any information / data required by converthink for using the converthink services shall be provided by the converthink Member, as and when so sought by converthink.
    3. You are requested to verify the credentials of the prospect, exercise due care and caution regarding their profile information which includes marital status, educational qualifications, financial status, occupation, character, health status, etc. and satisfy yourself before making a choice of your match. converthink shall not be liable for short coming due to any misrepresentations made by any of its converthink members.
    4. You are required to verify the credentials of the prospect and we shall not be liable for any misbehaviour / misrepresentations made by the Prospect to you during video call.
    5. To get better search results, converthink Members are expected to provide latest photograph which should not be more than 3 (three) months old. Providing old photographs/ photographs of others, inaccurate / false information shall be treated as violation of terms and conditions and converthink shall retain their right under clause 2 (b) of this terms and conditions.
    6. converthink members are expected to disclose their health records during profile enrolment which includes any pre-existing illness, physical disability etc. Non - disclosure at the time of enrolment shall be treated as violation of the terms and conditions and converthink shall retain their right under clause 2 (b) of this terms and conditions.
    7. converthink Members are advised to refrain from the following activities. If any such activities are done by any member or user, then converthink will not be responsible for any such/related actions or outcomes.
 
    1. Entering into any financial transactions with prospects. converthink Members shall not seek financial help or provide financial help from / to the other converthink Members.
    2. Using abusive language when they communicate with the other converthink Members
    3. Being discriminative or using racial comments etc.
    4. Sharing of confidential and personal data with each other but not limited to sharing of bank details, etc.
    5. Entering into physical relationship with any prospect before marriage.
    6. Violating any law which is in force.
    7. From mentioning details of other matrimonial services while sending personalized messages
 
    1. converthink Members are expected to be cautious of prospects who ask for favours, money etc or call from multiple phone numbers, only interact over phone, doesn't come forward for face to face meeting (physically or video calls) and don’t involve family and friends in match
    2. converthink members agrees that for getting effective search results of prospects on Website/App you will regularly log in to the profile maintained in the Website/App and send expression of interest which is an automated messages to prospects as a free converthink member, and in the event you have availed paid converthink package, you can send personalized messages to prospects to show your expression of interest/replies. Users also may review the expression of interest sent to you / read the messages sent to you by prospects and may respond accordingly.making. Beware of suspended profiles status before you finalize an alliance with the prospect.
    3. You also agree that while accessing / using the Website/App, you will be guided by the terms and conditions of the Website/App including but not limited to the use of various feature of website /App like chat instantly with prospect, viewing horoscope of prospects, enhancing privacy settings (photo / horoscope / phone number, etc) or for viewing social and professional profile of members on their Facebook, LinkedIn, etc.
    4. If the Users fails to update any changes in the particulars furnished in their profile in converthink website/App, then the converthink membership may be suspended by converthink at its sole discretion.
    5. In case of finalization of his/her/their Registrant’s marriage, the user must delete their profile by themselves or intimate converthink for removal / deletion of their profile.
    6. converthink Members agree to use secure devices, software and networks for accessing the converthink services for better experience and results.
    7. Users shall not use any kind of Bots like web robots, Chatbot or any other automated processes/programs/scripts to use, communicate or respond in converthink Website/App.
    8. You shall also not make any payment / transfer any amount to account of any employees / associates / members of converthink / TCPL/ any associate/ franchise firms. All payments shall be made only to converthink / TCPL bank account mentioned in the official website. In case of any confusion you may contact our call center.
    9. converthink members are expected to approach converthink / TCPL to resolve their personal complaints and grievances, and shall not air their grievance / complaints in social media or any public platform.

14. Communication to converthink Members
    1. Users hereby consents for receiving communication including promotional communications through any medium of communications such as electronic mails, calls, SMS or through Whatsapp messages from converthink / TCPL or other portals owned by the company or their associate partners.
    2. converthink by its automatic system sends to its member (s) profile (s) of the prospect by way of images / documents / messages / links. Users confirm that the mobile number submitted to it for verification or alternative number if any provided, is not registered with the Do Not Disturb / National Customer Preference Register and they shall not initiate any complaint. User further confirms that even if User is registered with the telecom service provider under the category Do Not Disturb / National Customer Preference Register the calls from converthink either to the verified mobile number or alternative number if any provided shall not be treated as promotional calls.

15. Feedback Confidentiality
Any feedback you provide to converthink shall be deemed to be non-confidential. converthink shall be free to use such feedback / information on an unrestricted basis. Further, by submitting the feedback, you represent and warrant that (i) your feedback does not contain confidential or proprietary information of yourself or third parties; (ii) User is not under any obligation of confidentiality, express or implied, with respect to the feedback; (iii) you are not entitled to any compensation or reimbursement of any kind from converthink for the feedback under any circumstances.

16. Privacy of Membership
      1. To protect your privacy and understand our practices as amended from time to time, please read and follow our Privacy Policy which also governs your visit to converthink and other websites owned by TCPL.
      2. The personal information / data provided to us by you during the course of usage of converthink website will be treated as confidential and in accordance with the Privacy policy and applicable laws and regulations. If you object to your information being transferred or used, please do not use the website.

17. Disputes between Members
    1. converthink Members are solely responsible for the communications (through any medium) with prospect or vice versa. converthink expressly disclaims any responsibility or liability for any monetary transaction(s) or exchange(s) or interaction(s) or passing of information(s) etc. between any converthink members via e-mail, chat, interaction, Whatsapp or any other medium of communication between converthink members either using website /App or otherwise.
